بيان صحافي حول سياسة الإخفاء القسري للمفقودين والمعتقليــــــن
في سجــــون الاحتـــلال الإسرائيلــــي بعــد عدوان 7 أكتوبر على غزة
تتابع الشبكة الحقوقية لأجل فلسطين)نداء) بقلق بالغ تصاعد سياسة الإخفاء القسري التي تنتهجها سلطات الاحتلال الإسرائيلي بحق المعتقلين الفلسطينيين، وخاصة منذ بدء عدوانها الواسع على قطاع غزة في السابع من أكتوبر/تشرين الأول 2023. وتشمل هذه السياسة حرمان عائلات المعتقلين من معرفة أماكن احتجازهم أو أوضاعهم الصحية، ومنعهم من التواصل مع محاميهم، ما يشكل انتهاكًا صارخًا للقانون الدولي الإنساني والقانون الدولي لحقوق الإنسان.
ففي ذكرى اليوم الدولي لضحايا الاخفاء القسرى الموافق ل 03 أغسطس من كل عام، تشير المعلومات التي وثّقتها المؤسسات الحقوقية الفلسطينية في الارض المحتلة إلى أن الاحتلال الاسرائيلي قام بنقل آلاف المعتقلين الفلسطينيين، من غزة والضفة الغربية، إلى أماكن احتجاز سرية أو غير معلنة، وسط تقارير مقلقة عن تعرضهم للتعذيب وسوء المعاملة، وحرمانهم من الرعاية الطبية.
فقد افاد المركز الفلسطيني للمفقودين والمختفين قسرياً في غزة ان عدد المفقودين المعلن عنهم قد بلغ 11،000 مفقود تشمل المعتقلين المخفيين قسريا والمفقودين تحت الانقاض وفق التقديرات الميدانية، حيث تم تسجيل 5000 بلاغ حول المفقودين في غزة وذلك حتى تاريخ 03 أغسطس الحالي .
القانون الدولي، ولا سيما اتفاقية مناهضة التعذيب (1984) والاتفاقية الدولية لحماية جميع الأشخاص من الاختفاء القسري (2006)، يجرّم الإخفاء القسري ويعتبره جريمة ضد الإنسانية إذا ما ارتُكب على نحو واسع أو منهجي. كما تفرض اتفاقية جنيف الرابعة (1949) على قوة الاحتلال واجب إبلاغ عائلات المعتقلين بمكان احتجازهم، والسماح بزيارتهم، وضمان حقوقهم الأساسية.
تؤكد الشبكة الحقوقية لأجل فلسطين (نداء) أن هذه الممارسات تمثل انتهاكًا جسيمًا للالتزامات القانونية الدولية، وقد ترقى إلى جرائم حرب وجرائم ضد الإنسانية، الأمر الذي يستوجب محاسبة المسؤولين عنها أمام المحكمة الجنائية الدولية والآليات الدولية ذات الصلة.
وعليه، تطالب الشبكة الحقوقية لأجل فلسطين(نداء) بما يلي:
الكشف الفوري عن أماكن احتجاز جميع المعتقلين الفلسطينيين. السماح الفوري بزيارات اللجنة الدولية للصليب الأحمر للمعتقلين والاطلاع على أوضاعهم. وقف سياسة الإخفاء القسري وكل أشكال التعذيب وسوء المعاملة. فتح تحقيق دولي عاجل تحت إشراف الأمم المتحدة لمحاسبة المسؤولين عن هذه الانتهاكات.
تدعو الشبكة الحقوقية لأجل فلسطين (نداء) المجتمع الدولي، بما فيه مجلس حقوق الإنسان والأطراف السامية المتعاقدة على اتفاقيات جنيف، إلى تحمل مسؤولياته القانونية والأخلاقية، والضغط على سلطات الاحتلال لاحترام التزاماتها الدولية وإنهاء جميع الانتهاكات بحق المعتقلين الفلسطينيين.
