دعوة حزب الخُضر البريطاني لتصنيف الجيش الإسرائيلي منظمة إرهابية
الشبكة الحقوقية لأجل فلسطين ترحّب بدعوة حزب الخُضر البريطاني لتصنيف الجيش الإسرائيلي منظمة إرهابية وتحثّ الحكومات على اتخاذ خطوات مماثلة
تُرحّب الشبكة الحقوقية لأجل فلسطين بقرار مؤتمر حزب الخُضر في إنجلترا وويلز الذي دعا الحكومة البريطانية إلى إدراج الجيش الإسرائيلي ( IOF) على لائحة المنظمات الإرهابية بموجب قانون مكافحة الإرهاب البريطاني. إننا نعتبر هذه الخطوة محطةً مهمة في مسار المساءلة ومنع الإفلات من العقاب على الانتهاكات الجسيمة والممنهجة المرتكبة بحق المدنيين الفلسطينيين.
تؤكد الشبكة أن التصنيف القانوني للمنظمات الإرهابية في المملكة المتحدة اختصاصٌ لوزير الداخلية وفق قانون مكافحة الإرهاب لعام 2000، ونطالب الحكومة البريطانية باستخدام هذه الصلاحية بصورة محايدة أيديولوجيًا تجاه كل طرف يستخدم الإرهاب كأداة، بما في ذلك القوات النظامية عندما تتوافر الأدلة والمعايير.
لقد وثّقت منظمات دولية ووكالات أممية نطاقًا كارثيًا من الانتهاكات في غزة والضفة الغربية، من الهجمات العشوائية والتجويع كسلاح حرب إلى التهجير القسري واسع النطاق، وما نتج عنه من مجاعة وأرقام غير مسبوقة من الضحايا والدمار، ومع إقرار حزب الخُضر بهذه الصورة وبدعوته للتصنيف، فإننا نحثّ الدول الأوروبية وسائر الحكومات الى ما يلي:
تفعيل أنظمة العقوبات الفردية (حظر السفر، تجميد الأصول) بحق المسؤولين المتورّطين في الانتهاكات الجسيمة.
تعليق تصدير السلاح وأي مواد أو تقنيات تُستخدم في ارتكاب انتهاكات خطيرة للقانون الدولي الإنساني.
دعم التحقيقات القضائية الدولية، وفي مقدمتها المحكمة الجنائية الدولية، والتعاون الكامل مع آليات التحقيق الأممية المستقلة.
النظر في تصنيف الجيش الإسرائيلي كمنظمة إرهابية حيثما تسمح الأُطر القانونية الوطنية، متى ما توفّرت معايير التصنيف وأدلته؛ على أن يكون التصنيف جزءًا من منظومة شاملة للمساءلة لا تستثني أي جهة ترتكب أعمالًا تندرج في تعريف الإرهاب.
إن المصداقية القانونية والأخلاقية تقتضي أن تُطبَّق المعايير نفسها على الجميع دون استثناء؛ فـالقانون الدولي لا يميّز بين فاعلٍ مسلحٍ غير دولتي وقوةٍ نظامية إذا ارتكبت أفعالًا إرهابية أو انتهكت قواعد الحرب ومبادئ التمييز والتناسب والضرورة.
ختامًا، تدعو الشبكة الحقوقية لأجل فلسطين المجتمع الدولي إلى التحرك الفوري لوقف الانتهاكات، وضمان حماية المدنيين، وتمكين الوصول الإنساني غير المقيّد، واتخاذ خطوات تنفيذية تُنهي حلقات العنف والإفلات من العقاب.
